Our expertise includes advising on land contamination, Japanese knotweed, radon, Environmental Permits and flooding issues. All these need to be carefully managed whether acting for the buyer, seller or funder.

Environmental issues, in particular, can be complex although with expert legal advice they do not have to be deal breakers. We have assisted firms of solicitors in a range of transactions from simple residential purchases where the environmental search ‘fails’ through to the purchase or sale of complex industrial sites being redeveloped for residential properties.

Case studies

Assisting a law firm when their client was selling a former factory site which was heavily contaminated. We reviewed the environmental reports, drafted contractual clauses to ensure that liability passed to the buyer and provided advice to the law firm’s client on their residual liability.

Advising a law firm in relation to a residential purchase where the standard environmental search ‘failed’ in relation to what information to provide the client and what risk mitigation measures were appropriate. 

Drafting and advising on a radon retention agreement / bond when a property was highlighted to be at risk and required further testing and potentially works to reduce the risk.
