The client of a law firm had obtained a planning permission subject to the negotiation of a s106 Agreement. The agreement drafted by the local authority contained complex provisions relating to the provision of affordable housing and the investigation and remediation of land contamination. We negotiated with the local planning authority around viability and the proposed agreement, a suitability worded s106 Agreement, was entered into.
