We are instructed by Professor Stephen Hawking, Dr Colin Hutchinson, Professor Allyson Pollock, Professor Sue Richards and Dr Graham Winyard in a proposed judicial review of the Secretary of State for Health and NHS England's introduction of non-NHS bodies to run health and social services without proper public consultation and full Parliamentary scrutiny. These non-NHS bodies, called “Accountable Care Organisations” could be given “full responsibility” for NHS and adult social services. We assisted a law firm when their client was selling a former factory site which was heavily contaminated. We reviewed the environmental reports, drafted contractual clauses to ensure that liability passed to the buyer and provided advice to the law firm’s client on their residual liability.
We acted in a corporate transaction for a buyer of an industrial site. Working alongside their regular law firm we handled the environmental aspects of the transaction including the environmental due diligence, warranty and indemnity negotiating and negotiating an environmental insurance policy.
